1. About these terms
These Terms of Service (“Terms”) govern your access to and use of the Binandicator website, terminal, signal feed, application programming interface and mobile app (together, the “Service”). The Service is operated by Binandicator (“Binandicator”, “we”, “us”). By creating an account, buying a subscription, or using any part of the Service, you confirm that you have read, understood and accepted these Terms, the Risk Disclosure, the Disclaimer and the Privacy Policy. You also confirm that you are at least 18 years old.
2. What Binandicator is — and what it is not
Binandicator provides algorithmic market analysis, trading signals, educational content and software that can connect to your own exchange account and place orders based on those signals.
Binandicator is not a broker, exchange, dealer, fund manager, custodian or investment adviser. We do not hold, control or have access to your funds. All orders are placed on your own trading account at your own exchange, and you remain the legal owner and controller of that account at all times.
3. No financial advice
Nothing on the Service constitutes personal financial, investment, legal or tax advice, and nothing is a recommendation or solicitation to buy, sell or hold any cryptocurrency or other financial instrument. Signals, performance figures, backtests and statistics are informational only. You are solely responsible for your own trading decisions and for evaluating whether the Service is suitable for you.
4. Regulatory information
Binandicator provides algorithmic market analysis, trading signals, educational content and software. Binandicator is not a bank, broker, exchange, dealer, fund manager or custodian, and we never hold or control your funds.
Binandicator is not authorised or supervised as a crypto-asset service provider (CASP) under Regulation (EU) 2023/1114 (MiCA). We do not provide regulated financial services, and nothing we provide is a substitute for advice from an authorised provider.
Where you choose to connect your own exchange account, you remain the account holder and you keep full control: orders are placed through your own exchange account on your instruction, with API keys you create yourself (trade permission only, never withdrawal permission). You can stop trading at any time with “Stop all” or “Disconnect”, or by deleting the key at your exchange.
Signals, analysis, performance figures and statistics are general market information. They are not personal advice, a personal recommendation or an offer to buy or sell any crypto-asset.
5. Complaints and dispute resolution
If you are unhappy with the Service, please write to us through the Contact page from the e-mail address on your account, and describe what has happened. We confirm receipt within 5 business days and aim to give you a full written answer within 14 calendar days. Our complaints procedure is described in full at Complaints.
If we cannot resolve your complaint and you believe our marketing, terms or handling breaches consumer law, you can contact the Danish Consumer Ombudsman (Forbrugerombudsmanden). For cross-border questions, the European Consumer Centre Denmark (ECC Danmark) can help you free of charge.
6. Your account
- You must be at least 18 years old. Accounts and subscriptions for anyone under 18 are not permitted.
- You must provide accurate information and keep it up to date.
- You are responsible for keeping your login credentials confidential and for everything that happens on your account.
- Access is limited to one active device session at a time. Signing in on a new device ends the previous session.
- Memberships and signal access are personal and may not be shared, resold, sublicensed or redistributed.
- Tell us immediately if you believe your account has been accessed without your permission.
7. Subscriptions, payment and cancellation
- Access requires an active subscription. Current plans are monthly, annual and lifetime, with prices shown on the pricing section of the website. Prices are in US dollars.
- Payments are handled by third-party payment providers, including cryptocurrency payments processed through our payment provider. Once a payment is confirmed on the blockchain it is final and cannot be reversed.
- Monthly and annual subscriptions renew automatically until cancelled. You can cancel at any time by contacting us; your access then continues until the end of the period you have already paid for.
- Because the Service is digital content delivered immediately, you agree that delivery begins as soon as your payment is confirmed, and you lose any statutory right of withdrawal for that purchase. Fees already paid are non-refundable except where a refund is required by mandatory law.
- We may change prices and plan contents for future billing periods. Changes never apply retroactively to a period you have already paid for.
8. Auto-trade (optional feature)
Auto-trade is an optional feature that connects Binandicator to your own exchange account through API keys you create yourself.
- The API key must be created with trading permission only. We do not ask for, and you must never enable, withdrawal permission.
- Your API keys are encrypted and stored only for the purpose of placing and managing orders on your behalf. You can remove them at any time by disconnecting inside Binandicator or by deleting the key at your exchange.
- You choose the active timeframe, the order size and the leverage (up to 17x). We may cap or reject an order for risk, technical or regulatory reasons.
- When auto-trade is enabled, the engine acts mechanically on the signals it receives. Orders can therefore be placed, modified or closed while you are away from the screen and without any further confirmation from you.
- The engine may pause, reduce or stop trading at any time, for example during maintenance, on exchange errors, or if your subscription expires.
- You can stop everything instantly with “Stop all” (closes open positions) or “Disconnect” (removes the connection and stops new trades at Binandicator). Emergency stops depend on the exchange accepting and executing the order.
- We do not guarantee that a signal is executed, that an order is filled at a particular price, or that a position is closed at the intended level. See the Risk Disclosure.
9. Acceptable use
You agree not to copy, resell, publish or share signal content; not to reverse engineer, scrape or attempt to extract the algorithms behind the Service; not to use the Service in a way that breaks the law or the rules of your exchange; and not to interfere with, overload or attempt to gain unauthorised access to the Service.
10. Availability and changes
The Service is provided on an “as is” and “as available” basis. We work to keep it running, but we do not guarantee uninterrupted or error-free availability. We may add, change or remove features, and we may suspend the Service for maintenance, security, legal or regulatory reasons.
11. Intellectual property
All rights in the Service — including the TX1K Core engine, signals, software, design, text and trademarks — belong to Binandicator. You receive a personal, non-exclusive, non-transferable and revocable licence to use the Service for your own trading during your active subscription. All other rights are reserved.
12. Limitation of liability
To the fullest extent permitted by law, Binandicator is not liable for trading losses, lost profits, lost opportunity, or any indirect, special or consequential loss arising out of or in connection with your use of the Service, including losses caused by following a signal, by automated execution, by exchange downtime, by failed or delayed orders, or by interruptions in the Service.
Our total aggregate liability towards you is limited to the subscription fees you have paid to Binandicator in the twelve months immediately before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for intent or gross negligence, or your mandatory rights as a consumer.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if payment fails, or if we are required to do so by law, by a regulator or by our payment or exchange partners. When access ends, automated trading stops and any stored API credentials are deleted.
14. Third-party services
Exchanges, payment providers and other third parties you use together with the Service have their own terms and privacy policies. We are not responsible for their services, for their availability, or for decisions they make about your account.
15. Governing law and disputes
These Terms are governed by the laws of Denmark, and disputes may be brought before the Danish courts. If you are a consumer resident in another EU/EEA country, this does not deprive you of the protection of the mandatory consumer law of your country of residence, and you may also bring proceedings there.
16. Changes to these Terms
We may update these Terms as the Service develops. The version in force is always the one published on this page, with the date shown at the top. Material changes will be announced on the website. If you continue to use the Service after a change takes effect, you accept the updated Terms.
